| During
these eleven years period of implementation of the Gujarat Advocates'
Welfare Fund Act, 1991 the Bar Council of Gujarat has experienced
certain difficulties & problems with a view to have effective
implementation and for providing better benefits to its members
the Bar Council of Gujarat has proposed certain amendments in
the Gujarat Advocates' Welfare Fund Act, 1991 and has recently
moved the State Government in the matter of amending the said
Act.
Under
the Scheme for financial aid to indigent and/or disabled advocates
framed by the Bar Council of Gujarat under Section 6(2) (a) of
the Advocates Act, 1961 till date amount of Rs. 5,22,325 has been
disbursed to sizeable number of advocates.
Earlier
the Bar Council of India Advocates Welfare Committee functioning
under Rules 40 to 44A of Section IV-A of Chapter II of the Bar
Council of India Rules granted aid of Rs. 42,600 to indigent and
disabled advocates.
The
Bar Council of Gujarat has, in its Meeting held on 8-7-2001, decided
to implement Rules 40 to 44B in Section - IVA, Chapter II, Part
VI of the Bar Council of India Rules pertaining to Advocates'
Welfare Schemes framed by Bar Council of India and has collected
sizeable amount of Rs. 89,70,750 out of which 20% is payable to
Bar Council of India and interest accrued on the investment of
rest amount of 80% is to be utilized for various Welfare Schemes
under the said Rules of BCI. The BCG has immediately thereafter,
in its Meeting held 2-9-2001 considered and approved Welfare Schemes
for (1) Scheme for Granting Financial Assistance to Indigent
Practicing Advocates when suffering from serious ailment, (2)
Financial assistance to Indigent and Disabled Advocates and (3)
Scheme for Library Development on the line of Model Schemes
of BCI wherein amount provided for was appropriately enhanced
and were sent to BCI for approval. The BCI has approved the said
Welfare Schemes in its Meeting held on 25th & 26th October,
2002. Bar Council of Gujarat has now in its Meeting held on 18-12-2002
adopted the aforesaid Welfare Schemes for its implementation.
The Bar Council of Gujarat proposes to disburse the financial
assistance to the deserving Advocates from the interest income
from the investment of the said 80% collected amount. Appropriate
announcement of the said Welfare Schemes for the information of
the Members of the Bar in the State of Gujarat. |
